Welcome to the Cains Moore ("Della Rovere") website. The Site is owned and operated by Della Rovere srl, with registered office at Via Molinetto 40/A, Longastrino (FE) – Italy, phone number 0532 806594, VAT number 01528630385 ("Della Rovere", "we", "our"). We invite you to carefully read these terms of use of the Site ("Terms of Use") before proceeding to access or use the Site.

1. Site Activity

These Terms of Use apply to all visitors or users of the Site. The Site displays, publishes, promotes, sells and distributes the Owner's products ("Products") under the registered trademark "Della Rovere". The Site offers multiple features to inform Users about the Products and services available on the Site and to facilitate the completion of Orders, such as, for example, the possibility for Users to:

• register on the Site, thereby activating a personal account to access restricted areas and content; • subscribe to mailing lists to receive newsletters relating to the Products and Site initiatives; • participate in promotional initiatives.

Users are invited to provide true and correct personal data and to update the personal data ("Personal data") provided during registration whenever it is no longer current, as well as to read the Privacy Policy and the Cookie Policy regarding the processing of Personal data and the rights granted to Users under applicable privacy legislation.

2. Changes to the Terms of Use

Della Rovere reserves the right to modify, revise, add to or delete part of the Terms of Use by updating this document, at any time and without prior notice. Changes to the Terms of Use will be communicated by posting a notice on the Site. We therefore invite you to periodically check the Terms of Use. If you do not accept any such changes, you must stop accessing or using the Site; use of the Site after the changes are published constitutes your acceptance of the changes.

3. Proprietary Content

All rights and interests in the Site and in any part of its content, including for example the software, HTML code, other computer code contained on the Site, text, graphics, user interface, visual interface, scripts, artwork, photographs, images, drawings, video and audio materials, texts and other materials appearing as part of the Site (collectively, "Content") are owned by Della Rovere and/or Della Rovere's licensors. All Content is protected by national intellectual property laws, including for example copyright, patent, trademark laws and other international laws and treaties concerning intellectual property rights.

4. Registered Trademarks and Logos

All trademarks, trade names, logos, brands and product names included on the Site are the exclusive property of Della Rovere or their respective companies ("Trademarks"). The Terms of Use do not grant any right or license to use the Trademarks, and we remind you that any use of the Trademarks is strictly prohibited.

5. Our Products

From time to time we may, without notice, modify or remove (permanently or temporarily) some of the products and services and/or their related features and specifications that are displayed or made available to you through the Site; we may also change the prices applicable to such products or services without notice. Our terms of sale also govern the circumstances under which we may modify and/or withdraw products sold by us through the Site. Although we make reasonable efforts to ensure that the information available on the Site is accurate and constantly updated, we provide no guarantee of the correctness, completeness, accuracy or timeliness of the information present on the Site, including for example product descriptions, prices and/or availability indications shown on the Site. The fact that certain products or services are included on the Site does not constitute any guarantee of their availability through the Site should you wish to place an order for such products and/or use such services at any given time. We have made every effort to ensure that the colors of our products shown on the Site are displayed as realistically as possible. However, the color you actually see depends on your computer's settings, and we cannot guarantee that your computer will display our colors correctly.

You may never use the password or Account of third parties, as defined below, without the explicit authorization and consent of the account holder. You may not test, probe or check the vulnerability of the Site or of any other network connected to the Site, nor breach the security or authentication measures present on the Site. You may not conduct reverse look-up, tracking or attempted tracking of any information relating to other users, visitors to the Site or any other customer; you may not exploit the Site or any service or information made available or offered by or through the Site; you may not use the Site or the Content for any unlawful purpose or purpose not permitted by the Terms of Use, and you may not encourage third parties to engage in any unlawful activity or activity that violates the rights of Della Rovere or third parties. You must not carry out any activity that places an unreasonable or disproportionate load on the Site's infrastructure or on any system or network connected to the Site. You agree not to use any device, software or mechanism to interfere or attempt to interfere with the proper functioning of the Site, with any operation the Site may be performing, or with any other person's use of the Site.

7. Registration and Account

Certain services or features offered on or through the Site may require you to register and open an account ("Account"). If you wish to create an Account, you will need to provide an email address and a password to access your Account. You are responsible for maintaining the confidentiality of your login information and for controlling access to your Account. You will be responsible for all activities carried out through your Account (including, for example, any purchase of our products made through your Account) unless you notify us that your Account is being used by a third party without your consent. Della Rovere cannot be and will not be held liable for any loss or damage arising from your failure to comply with these obligations.

We may delete your Account at any time and without notice if: (a) we reasonably believe you are using the Account in violation of these Terms of Use, (b) we reasonably believe a third party is using your Account without your consent, or (c) we need to delete or suspend your Account for security or maintenance purposes.

8. Chat

Della Rovere is progressively providing Site users with a WhatsApp service in order to offer assistance during the sales, after-sales and browsing support phases on the Site. To use the WhatsApp service, you must provide your name (or, alternatively, a nickname) and your email address. The WhatsApp service must not be used for fraudulent, illegal, offensive purposes or purposes that could in any way cause harm or risk to Della Rovere, its business, reputation, employees, other users or any third party. Della Rovere reserves the right to suspend or discontinue the WhatsApp service in the event of misuse.

9. Feedback and Other Communications

Any feedback, comment, suggestion, idea and/or other information (collectively, "Communications") sent to the Site, including via the WhatsApp service (to the extent it is made available), will be considered non-confidential. We reserve the right to use such Communications without limitation, for example by copying, reproducing, publishing, disclosing, distributing, displaying, modifying, translating, incorporating them into other materials and exploiting them commercially in any way. Della Rovere shall have the unrestricted right to use ideas, concepts, know-how or techniques contained in the Communications you send us for any purpose, for example to develop, produce and market products using such information. Della Rovere invites you not to send us any information you consider confidential or proprietary through the Site.

10. Privacy Policy

When you purchase products from the Site or otherwise use the Site, we may ask you to provide your personal data: the personal data you provide to Della Rovere through the Site are subject to our Privacy Policy. By using the Site, you acknowledge and accept that internet communications are never completely confidential and secure, and you understand that any message or information you send to the Site may be read or intercepted by others, even where an explicit notice informs you that a particular transmission is encrypted (for example, a transmission of credit card information).

12. Disclaimer of Liability

You use the Site at your own risk and are solely responsible for your use of the Site and of Third-Party Content and Sites. Della Rovere takes all necessary measures to attempt to ensure that the Site and the Content do not contain viruses or defects, but cannot guarantee that your computer equipment, hardware or software, or the data stored or created by your computer equipment, hardware or software (collectively, "Equipment"), will not be damaged, lost, or otherwise adversely affected if you access or use the Site or the Content. Furthermore, Della Rovere does not guarantee that the Site or the Content, services or features of the Site will be uninterrupted, that any defects will be corrected, or that your use of the Site will produce specific results. The Site and the Content are provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, Della Rovere provides no warranty, express or implied, including any warranty of accuracy, completeness, non-infringement of third-party rights, merchantability or fitness for a particular purpose. 13. Limitation of Liability

To the maximum extent permitted by applicable law, Della Rovere shall in no event be liable to you or to anyone else for any damage arising from the use of the Site and/or the Content or any information contained on the Site or the products sold through it, including, for example, liability for (I) any loss or damage to data, (II) loss or damage to your Equipment, (III) any loss or damage that was not foreseeable by you or by us, or that you did not notify us could occur, in the event of our violation of the Terms of Use or of our legal duties of care towards you, or (IV) any loss or damage suffered by you as a result of your failure to take reasonable precautions against such losses or damages, for example by installing adequate antivirus software. Nothing in the Terms of Use excludes or limits our liability towards you in the case of a third-party statement made available on or through the Site under criminal or civil law provisions relating to defamation, intellectual property infringement, privacy, obscenity or other applicable regulations, willful misconduct or gross negligence, or for any other liability that cannot be excluded or limited under applicable law.

14. General Provisions

These Terms of Use are governed by Italian law, without regard to private international law rules. The Court of Ferrara (Italy) shall have exclusive jurisdiction over all disputes arising from the use of the Site and/or relating to the Terms of Use, without prejudice to any right granted by law to Della Rovere to bring legal proceedings in the place of residence or habitual domicile of users.
